5-Step QDRO Process:
Step 1: (Obtain Information) To begin the QDRO process we must be provided with the following: The QDRO Checklist and a copy of the filed Divorce Decree or Separation Agreement(only the section that discusses the retirement account assets), a Summary Plan Description and Written QDRO Procedures (if available). We will contact the Plan to obtain any additional information, as needed.
Step 2: (Drafting of Proposed QDRO) Upon receiving all requested information from Step 1, we will draft the Order. The Order will then be sent to both parties and/or their attorneys for review and approval. We ask that all parties review the draft carefully, making sure all information is accurate. If questions arise or updates are needed, please contact us. The Order does not need to be signed at this point.
Step 3: (Plan Administrator Approval of Proposed QDRO) Once all parties approve the proposed Order, the Order will be sent to the Retirement Plan Administrator for pre-approval. If any corrections are recommended by the Plan, both parties and/or their attorneys will be notified. Normally, any recommended corrections involve minor wording changes, which will not affect the amount. Once the corrections are made, the Order, along with a list of corrections, will be sent back to both parties and/or their attorneys for approval.
Step 4: (QDRO Filing & Judge’s Signature) Once the proposed Order is approved by the Plan, we will send both parties a corrected copy, which should then be signed by the parties and/or their attorneys. The parties and/or their attorneys will then be responsible for submitting the Order to the Court for filing. A judge's signature will also be obtained at this time.
Step 5: (Submitting Filed QDRO) After the QDRO is signed by the Judge, and filed with the court, a certified copy will be obtained. The filed Order and Personal Information Sheet are then sent to the Plan for processing. Additionally, copies of the filed QDRO will also be sent to both parties, along with the Personal Information Sheet.
